Agreement

These Terms of Use ("Terms") are an agreement between you and Wensheng Liu ("we", "us") and govern your use of the Sunvi app and this website (together, the "Service"). By downloading or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

These Terms are between you and us only, not with Apple. Where these Terms are silent, Apple's Standard Licensed Application End User License Agreement applies.

The Service and translation accuracy

Sunvi translates text, speech and text found in images using on-device technology from Apple and, if you turn on AI-Enhanced Translation and you're online, AI translation from Google Gemini. Machine translation can be inaccurate, incomplete or miss cultural context. The Service is provided to help you communicate. It is not a certified or professional translation service.

Do not rely on Sunvi in emergencies, or for medical, legal, financial, safety or other decisions where a mistake could cause harm. In those situations, use a qualified human interpreter or official sources.

We may change, add or remove features, supported languages or providers over time.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Sunvi on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

Subscriptions, free trials and free allowances

• Free use. Some features include a free daily allowance, which resets at midnight in your device's time zone. We may adjust free allowances in the future.
• Sunvi Pro. Pro is offered as auto-renewing subscriptions (for example weekly, monthly or yearly). The price and length of each plan are shown in the app before you buy.
• Billing. Payment is charged to your Apple Account when you confirm the purchase. Apple processes all payments.
• Auto-renewal. Your subscription renews automatically for the same period and price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
• Free trials. If a plan includes a free trial, it converts to a paid subscription when the trial ends unless you cancel at least 24 hours before it ends. Any unused part of a free trial ends when you buy a subscription, where applicable.
• Managing and canceling. You can manage or cancel subscriptions in your iPhone's Settings under your name, then Subscriptions. Canceling stops future renewals; you keep access until the end of the paid period.
• Refunds. Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.
• Price changes. If a subscription price changes, Apple will notify you as required and, where required, ask for your consent before charging the new price.
• Fair use. Pro removes the daily allowances for normal personal use. To keep the Service available for everyone, we apply generous technical limits to prevent automated or abusive use.

Acceptable use

You agree not to:

• use the Service to break the law or to harass, threaten or harm anyone;
• translate content you don't have the right to use, or record or photograph people where that isn't allowed;
• copy, modify, reverse engineer or decompile the app, except where the law allows it;
• access our servers other than through the app, use automated means to send requests, or try to get around usage limits or security;
• resell the Service or use it to build a competing product.

We may suspend access to AI features for activity that breaks these Terms.

Your content

You keep all rights to the text, speech and images you use with Sunvi and to the translations you receive. You give us permission to process your content only as needed to provide the Service, as described in the Privacy Policy. You are responsible for the content you translate.

Our intellectual property

The app, its design, illustrations, name and logo belong to us or our licensors and are protected by law. These Terms don't give you any right to use our name or logo. If someone claims that the app or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and resolving that claim.

Third-party services

The Service relies on services from Apple, Google and others. Their availability is outside our control, and your use of Apple's services is also governed by Apple's terms. When you use the app, you must also follow any applicable third-party terms, such as your wireless carrier's agreement.

Apple-specific terms

• Apple is not responsible for the app or its content. We are solely responsible for the app.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that translations will be accurate or that the Service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from reliance on a translation. Our total liability for any claim relating to the Service is limited to the amount you paid for Sunvi in the 12 months before the claim, or US$50, whichever is greater.

Some places don't allow these exclusions or limits, so they may not apply to you. Nothing in these Terms limits rights you have under consumer protection laws that can't be waived.

Ending these Terms

You can stop using the Service at any time by deleting the app and canceling any subscription. We may suspend or end your access if you seriously or repeatedly break these Terms. Sections that by their nature should survive will survive.

Governing law

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict of laws rules. Disputes will be resolved in the state or federal courts located in New York, unless the law where you live requires otherwise.

Changes to these Terms

We may update these Terms. We'll change the date at the top of this page and, for material changes, tell you in the app before they take effect. If you keep using the Service after that, the updated Terms apply.
